Terms of Service

These Terms explain how you may use Pers.ws, how public pages and paid features work, and how risk and responsibility are allocated when you publish content, connect domains, add scripts, or use AI-assisted features.

Acceptance and scope

These Terms of Service ("Terms") govern your access to and use of Pers.ws, including the public website, creator pages, hosted content, analytics features, custom domains, downloadable assets, and the authenticated studio at my.pers.ws (collectively, the "Service").

By accessing or using the Service, creating an account, purchasing a paid plan, publishing a page, using an API or integration, or visiting a Pers.ws-hosted surface, you agree to these Terms. If you are using the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.

Eligibility, accounts, and security

You must provide accurate information, maintain the security of your account, and promptly update your details if they change. You are responsible for all activity that occurs under your account, including content, domain connections, scripts, billing actions, and administrative changes initiated through your workspace.

You may only use the Service if you can form a binding contract with Pers.ws, your use is not prohibited by applicable law, and you are not located in or ordinarily resident in a jurisdiction subject to comprehensive sanctions that would prohibit the Service from being provided to you. We may refuse registration, reclaim names or slugs, or require verification where reasonably necessary to protect users, third parties, or the integrity of the platform.

Your content, licenses, and public pages

You retain ownership of the text, images, links, files, branding, analytics IDs, AI prompts and outputs, and other materials you submit to the Service ("Your Content"). You give Pers.ws a worldwide, non-exclusive, royalty-free license to host, copy, store, display, transmit, cache, adapt, and distribute Your Content only as needed to operate, secure, improve, and promote the Service.

You represent and warrant that you have all rights, permissions, notices, and lawful bases needed to submit, publish, or distribute Your Content and to enable any custom code, tags, analytics IDs, or domain configurations you connect to the Service. You are solely responsible for Your Content, visitor disclosures, backup copies, and reviewing any AI-generated or automated output before using or publishing it.

Public pages may be indexed by search engines, cached by networks, mirrored by third parties, and visible to anyone with the URL or a linked custom domain unless a feature is explicitly marked private or access-controlled. Removing content from the Service may not remove copies already made by third parties.

Acceptable use

You may not use the Service to:

  • Violate any law, regulation, or third-party right.
  • Upload, distribute, or link to malware, phishing content, deceptive redirects, or other harmful code.
  • Publish content that is unlawful, infringing, fraudulent, exploitative, hateful, threatening, or invasive of another person's privacy.
  • Impersonate another person or organization, misrepresent affiliation, or engage in spam, scams, misleading promotions, or deceptive marketing practices.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems, or interfere with security, rate limits, or entitlement controls.
  • Use automated means to scrape, overload, benchmark, reverse engineer, or disrupt the Service except as expressly permitted by Pers.ws.
  • Inject custom code, pixels, or scripts that steal data, degrade performance, mine cryptocurrency, inject ads, or otherwise harm visitors or the platform.
  • Upload or distribute regulated, restricted, or unlawful products, services, or content in a way that would create compliance obligations Pers.ws has not expressly agreed to undertake.

Paid plans, billing, and renewals

Some features require a paid subscription or add-on, including Creator, Pro, Studio, and Premium Naming. Pricing, billing interval, and included entitlements are presented at checkout and may change prospectively.

Billing is handled by Polar and its payment partners. By starting a paid plan, you authorize recurring charges, applicable taxes, and fees until you cancel. Unless required by law or expressly stated otherwise in writing, fees are non-refundable and non-creditable, including for partial billing periods, feature downgrades, unused time, or reduced usage.

If a payment fails, a subscription ends, a charge is reversed, or an entitlement becomes inactive, Pers.ws may downgrade features, stop rendering premium functionality, suspend access to paid tools, revoke promotional pricing, or release reserved resources such as short names in line with the product rules presented at purchase.

We may change prices, packaging, or entitlements on a prospective basis. If we offer a discount, credit, or promotional term, it is specific to that offer and does not create an obligation to continue it in the future.

AI, beta, and experimental features

The Service may include AI-assisted, beta, preview, or experimental features. Those features may be inaccurate, incomplete, unavailable, or changed or removed at any time without notice.

You are solely responsible for reviewing any AI-generated or automated output for accuracy, rights clearance, compliance, and suitability before relying on it, publishing it, or providing it to others. Pers.ws does not warrant that such output will be correct, original, non-infringing, or fit for any particular purpose.

Third-party services, domains, and custom code

The Service may integrate with third-party providers for authentication, billing, hosting, analytics, storage, domain management, and other infrastructure. Your use of third-party services is governed by those providers' own terms and policies, andPers.ws is not responsible for third-party acts, omissions, downtime, policy changes, fees, or security practices.

If you connect a custom domain, configure Google Analytics or Google Tag Manager, or inject custom code or tags, you are solely responsible for those configurations, including required disclosures, permissions, notices, and compliance with applicable privacy and marketing laws.

Pers.ws may disable, reject, or remove custom code, tags, domains, integrations, or assets that present security, legal, performance, or reputational risk, or that we reasonably believe violate these Terms.

Monitoring, enforcement, and takedowns

Pers.ws may, but is not obligated to, monitor the Service for security, abuse, misuse, legal risk, or Terms violations. We may investigate suspected violations, remove or restrict content, preserve evidence, cooperate with law enforcement or rightsholders, and suspend or terminate access without prior notice where reasonably necessary to protect the Service or others.

We have no obligation to pre-screen, verify, or monitor user content, visitor behavior, third-party scripts, or external links, and we do not endorse any user, page, asset, destination, or representation made through the Service.

Pers.ws is a platform that hosts and transmits content created and published by its users. Pers.ws is not the publisher or speaker of user content and does not adopt, ratify, or endorse any content, link, asset, or representation published by users through the Service.

Notices regarding infringement, misuse, or platform abuse may be sent to hello@pers.ws.

Termination and account closure

You may stop using the Service or close your account at any time. Pers.ws may suspend or terminate your access to the Service at any time, with or without cause, and with or without prior notice, including if we reasonably believe you have violated these Terms, pose a risk to the platform or other users, or for any other business reason.

Upon termination, your right to use the Service ceases immediately. Pers.wshas no obligation to retain, store, return, or forward Your Content or any other data after termination. You are responsible for exporting or backing up any data you wish to keep before your account is closed. Content you published publicly may have been cached, indexed, or copied by third parties before removal, and Pers.ws is not responsible for those copies.

Termination does not relieve you of any obligations that accrued before the effective date of termination, including payment obligations and indemnification duties. The following sections survive expiration or termination of these Terms: Your Content (license grants), Copyright, Acceptable Use, Platform Rights, Disclaimers, Limitation of Liability, Indemnity, Disputes, and General Terms.

Platform rights and feedback

The Service, including its software, design, trademarks, branding, and underlying technology, is owned by Pers.ws or its licensors and is protected by intellectual property laws. Except for the limited rights needed to use the Service under these Terms, no rights are granted to you.

If you send feedback, suggestions, or ideas about the Service, you grantPers.ws a worldwide, perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation.

Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pers.ws disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, and security.

Pers.ws does not guarantee uninterrupted availability, error-free operation, backup retention, successful domain resolution, accurate analytics, successful delivery of third-party scripts, or that content, links, assets, AI outputs, or materials provided by users, visitors, or third parties will be lawful, accurate, secure, available, or suitable for your needs.

The Service does not provide legal, tax, accounting, regulatory, medical, or other professional advice. You are solely responsible for obtaining advice appropriate to your business, content, audience, and jurisdiction.

Limitation of liability

To the fullest extent permitted by law, Pers.ws and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, reputation, or substitute services, arising out of or relating to the Service or these Terms.

To the fullest extent permitted by law, the total aggregate liability ofPers.ws for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amounts you paid to Pers.ws for the Service during the twelve months before the event giving rise to the claim or one hundred U.S. dollars (US$100). Multiple claims will not enlarge this cap.

The limitations in this section apply whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if a limited remedy fails of its essential purpose and even if Pers.ws was advised of the possibility of the damages.

Indemnity

You will defend, indemnify, and hold harmless Pers.ws and its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to Your Content, your use of the Service, your pages or assets, your custom code or integrations, your violation of these Terms, or your violation of any law or third-party right.

Pers.ws may assume exclusive control of the defense of any matter subject to indemnification, and you will cooperate with that defense. You may not settle any such matter in a way that admits fault by or imposes obligations on Pers.wswithout our prior written consent.

Disputes, time limits, and venue

Before filing a claim, you agree to first contact Pers.ws at hello@pers.ws and attempt to resolve the dispute informally.

To the fullest extent permitted by law, these Terms are governed by the laws of the jurisdiction where Pers.ws is operated, without regard to conflict-of-law rules, and any dispute or claim arising out of or relating to the Service or these Terms must be brought exclusively in the state or federal courts located in that jurisdiction. You consent to personal jurisdiction and venue in those courts.

To the fullest extent permitted by law, claims must be brought only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Any claim arising out of or relating to the Service or these Terms must be filed within one year after the event giving rise to the claim, or it is permanently barred.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent or restrain irreparable harm pending resolution of a dispute.

General terms and contact

Pers.ws may update these Terms from time to time. If we make a material change, we will post the revised Terms here and update the "Last updated" date above. Your continued use of the Service after the revised Terms become effective means you accept the updated Terms.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent. Pers.ws may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. Pers.ws is not liable for delay or failure caused by events beyond its reasonable control.

By using the Service, you consent to receive communications from Pers.wselectronically, including by email, in-product notices, or postings on the Service. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pers.ws regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and Pers.wsregarding the Service.

Section headings are for convenience only and do not affect interpretation. As used in these Terms, "including" means "including without limitation."
